Decision on disqualification of 'those' 16 MLAs shortly

 


New Delhi: The decision of disqualification of 16 MLAs of the Shinde faction is being delayed by the Assembly Speaker. The Thackeray group has filed a petition in the Supreme Court demanding an order to take an immediate decision in this matter. It will be heard in the Supreme Court today. Now, everyone is waiting to see whether the Supreme Court will tell the Assembly Speaker to take the decision to disqualify the 16 MLAs immediately or give some other instructions.

Meanwhile, the decision of disqualification of 16 MLAs of the Shinde group will be heard in the Supreme Court today at around 11:30. Thackeray Group MLA Sunil Prabhu has filed this petition in the Supreme Court. Sunil Prabhu's lawyer will argue in court today. Should Sunil Prabhu's plea be heard or should a notice be given to the Assembly Speaker? This court is going to decide today. This hearing will be held in front of Chief Justice Dhananjay Chandrachud, Justice Narasimha, and  Mishna. 

In the petition filed by MLA Sunil Prabhu, several claims have been made, including that the Assembly Speaker should immediately decide the disqualification of 16 MLAs. The petition claims that even after the passage of two months, there is no movement regarding the decision from the Speaker of the Legislative Assembly. It has also been alleged in the petition that Assembly Speaker Rahul Narvekar is deliberately delaying the hearing. It is also mentioned in the petition that the decision of the Supreme Court has been directed to be taken within the time limit.

 Expressing his opinion on the matter, senior lawyer Asim Sarode said that actually Rahul Narvekar was expected to take a decision in this matter within 15 days. The court can order immediately after the hearing. But it is unlikely to happen. Three months have been quoted. If there is a complicated case, a decision has to be given within three months. But looking at the principle of law and the constitutional provision, the court cannot give a time limit to the Speaker of the Legislative Assembly. The Supreme Court is consistently giving decisions respecting them. The court has given the decision to decide who is ineligible.Only Rahul Narvekar has to act.
